Subscriber Agreement

ABSnet Internet Services, Inc. ("ABSnet") exercises no control over the content of the information passing through it. Use of any information obtained via ABSnet is at your own risk. ABSnet specifically denies any responsibility for the accuracy or quality of information obtained through its services.
ABSnet makes no warranties of any kind, whether expressed or implied, for the service it is providing. ABSnet also disclaims any warranty of merchantability or fitness for a particular purpose. ABSnet will not be responsible for any damages you suffer. This includes, but is not limited to, loss of data, delays, nondeliveries, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions, or due to inadvertent release or disclosure of information sent by you. ABSnet is not responsible for your personal files residing on any of ABSnet's servers or systems.
ABSnet may only be used for lawful purposes. Transmission or storage of any information, data, or material in violation of any US Federal or State regulation or law is prohibited. This includes, but is not limited to: copyrighted material, material legally judged threatening or obscene, or material protected by trade secret. You agree to indemnify and hold harmless ABSnet from any claims resulting from your use of the service which damages you or another party or parties.
This account may not be used in any way that may considered abusive. This includes, but is not limited to, the following: Sending bulk or unsolicited electronic mail or netnews (either sent through ABSnet or using your ABSnet account as a reply address); harassing other individuals or organizations; posting or sending a message using forged or intentionally incorrect headers; accessing another network through ABSnet in violation of the rules for that network; or posing as a representative of ABSnet in any way.
This account may not be used in any way that creates excessive strain on ABSnet resources. This includes, but is not limited to, the following: Executing shell processes which use excessive CPU time or memory; executing shell processes which continue running after you have logged out; leaving your system connected to ABSnet when you are not using it, attempting to stay connected continuously; or placing files on your ABSnet web page (if you have one) which significantly increase the load on ABSnet’s servers (such as sexually explicit images or text).
You certify that you are at least 18 years of age.
ABSnet has the right to suspend and/or terminate service at any time without notice for reasons including, but not limited to, evidence which to ABSnet indicates that your use of the service may be in violation of any State or Federal law or regulation (Copyright, Trademark or otherwise), in violation of any term in this agreement, or is having an adverse effect on ABSnet or other networks.
Payment is due upon receipt of invoice. Accounts are in default if payment is not received within 15 days after date of invoice. If your check is returned to ABSnet unpaid, you are immediately in default and subject to a returned check charge of $25 from ABSnet. Accounts in default may have their service interrupted. Such interruption does not relieve you from the obligation to pay any amount charged to your account. Only a written request to terminate your service, received 30 days in advance, relieves you of your obligation to pay monthly account charges. Accounts in default are subject to an interest charge of 1.5% per month or your state's legal maximum allowable rate. If you default, you agree to pay ABSnet its reasonable expenses, including attorney and collection agency fees, incurred in enforcing ABSnet's rights under this contract. An act of default accelerates payments to be due immediately, as credit is no longer being extended.
ABSnet has the right to delete all data, files, electronic messages, or other information that is stored on our servers or systems when your account with ABSnet is terminated, for any reason, by either you or ABSnet.
This contract, along with the order form or signup sheet submitted with it, contains the entire agreement between you and ABSnet, and it may not be altered, amended, modified, terminated, or otherwise changed except in writing and signed by both you and ABSnet. ABSnet reserves the right to change rates or modify the service being provided by notifying you 30 days in advance of the effective date of the change. A limiting endorsement on a check or other form of payment will not be effective to modify your obligations or any of the other terms and conditions of this contract, and we may apply any payments received without being bound by such limiting endorsements.

Use of ABSnet constitutes acceptance of these Terms and Conditions.
